Biden wrong about the constitution 156
In addition to all his other mistakes or careless lies, Biden misrepresented facts about the constitution, which he seems not to know much about despite his decades in the Senate.

This isn’t what’s conventionally described as a gaffe, and it won’t swing any votes, but last night Joe Biden garbled the Constitutional role of the Vice President. I wanted to read the transcript before commenting; here was Gwen Ifill’s question:
Governor, you mentioned a moment ago the constitution might give the vice president more power than it has in the past. Do you believe as Vice President Cheney does, that the Executive Branch does not hold complete sway over the office of the vice presidency, that it it is also a member of the Legislative Branch?
Here is Biden’s answer, in full:
Vice President Cheney has been the most dangerous vice president we’ve had probably in American history. The idea he doesn’t realize that Article I of the Constitution defines the role of the vice president of the United States, that’s the Executive Branch. He works in the Executive Branch. He should understand that. Everyone should understand that.
And the primary role of the vice president of the United States of America is to support the president of the United States of America, give that president his or her best judgment when sought, and as vice president, to preside over the Senate, only in a time when in fact there’s a tie vote. The Constitution is explicit.
The only authority the vice president has from the legislative standpoint is the vote, only when there is a tie vote. He has no authority relative to the Congress. The idea he’s part of the Legislative Branch is a bizarre notion invented by Cheney to aggrandize the power of a unitary executive and look where it has gotten us. It has been very dangerous.
For a man of Biden’s experience, this is a surprising series of misstatements. First of all, he gets wrong one of the most basic facts about the Constitution: Article 1 establishes the legislative branch, not, as Biden said, the executive branch. This is not exactly an obscure fact…
Second, it simply isn’t true that the Constitution treats the Vice President only as a member of the executive branch. The Vice President is mentioned in Article II as part of the executive branch, but he is also given legislative powers by Section 3 of Article 1, which establishes the Senate:
The Vice President of the United States shall be President of the Senate, but shall have no Vote, unless they be equally divided.
Vice President Cheney’s "bizarre notion" is in keeping with the plain text of the Constitution.
Finally, Biden misstated the Vice President’s role in the Senate. It isn’t true that he "preside[s] over the Senate, only in a time when in fact there’s a tie vote." The Constitution contemplates that the Vice President will be the full-time President of the Senate, replaced by a President pro tempore "in the absence of the Vice President." It’s true that the Vice President only gets to vote in case of a tie; but, of course, that’s the only time it matters.
If Joe Biden were a high school student taking a test on the Constitution in a government course, he would get a C or a D. Some would say his mistakes were minor, and, as I said, they certainly won’t swing any votes. But it is distinctly odd that a man who has been in the Senate for more than three decades doesn’t understand the Constitutional role of the Vice President with respect to that body.

Joe Biden threw out a lot of bunk on foreign policy tonight, too bad Gov Palin didn’t have the foreign policy wonkishness to call him on it. Most ridiculous and downright strange was his contention that the Bush administration let Hezbollah into Lebanon, and then when “we threw them out” – whatever that means, he and Obama said NATO should go in but nobody took them up on it and now Hezbollah was all over Lebanon and that’s a problem. What?
Well, Hezbollah’s been there since the early 1980’s of course, blossoming throughout the 1990’s to become now over a third of the population of Lebanon with 2 cabinet members, a host of parliamentarians, and schools, clinics, and basically an entirely separate governance infrastructure in all of southern Lebanon and elsewhere. I suppose the throwing out of Hezbollah was the dismal and failed Israeli campaign of 2006 which dislodged nothing? Or was it Israeli’s occupation of Southern Lebanon from 1982 – 1999? Don’t remember an Obama position on NATO replacing Israeli occupation then. As for NATO going in after the 2006 debacle, well, I’m the one who rounded up 8,000 French and Italians and a few thousand other Euros to go into Southern Lebanon along with an assortment of others in August 2006 and while working that issue for about 40 straight days I don’t remember a peep from Biden or Obama about NATO – which wouldn’t be budged despite our intense pressure in Mons. So, we went straight to Rome and Paris. Que sera, sera.

1. TAX VOTE: Biden said McCain voted “the exact same way” as Obama to increase taxes on Americans earning just $42,000, but McCain DID NOT VOTE THAT WAY.
2. AHMEDINIJAD MEETING: Joe Biden lied when he said that Barack Obama never said that he would sit down unconditionally with Mahmoud Ahmedinijad of Iran. Barack Obama did say specifically, and Joe Biden attacked him for it.
3. OFFSHORE OIL DRILLING: Biden said, “Drill we must.” But Biden has opposed offshore drilling and even compared offshore drilling to “raping the Outer Continental Shelf.”
4. TROOP FUNDING: Joe Biden lied when he indicated that John McCain and Barack Obama voted the same way against funding the troops in the field. John McCain opposed a bill that included a timeline, that the President of the United States had already said he would veto regardless of it’s passage.
5. OPPOSING CLEAN COAL: Biden says he’s always been for clean coal, but he just told a voter that he is against clean coal and any new coal plants in America and has a record of voting against clean coal and coal in the U.S. Senate.
6. ALERNATIVE ENERGY VOTES: According to FactCheck.org, Biden is exaggerating and overstating John McCain’s record voting for alternative energy when he says he voted against it 23 times.
7. HEALTH INSURANCE: Biden falsely said McCain will raise taxes on people’s health insurance coverage – they get a tax credit to offset any tax hike. Independent fact checkers have confirmed this attack is false
8. OIL TAXES: Biden falsely said Palin supported a windfall profits tax in Alaska – she reformed the state tax and revenue system, it’s not a windfall profits tax.
9. AFGHANISTAN / GEN. MCKIERNAN COMMENTS: Biden said that top military commander in Iraq said the principles of the surge could not be applied to Afghanistan, but the commander of NATO’s International Security Assistance Force Gen. David D. McKiernan said that there were principles of the surge strategy, including working with tribes, that could be applied in Afghanistan.
10. REGULATION: Biden falsely said McCain weakened regulation – he actually called for more regulation on Fannie and Freddie.
11. IRAQ: Joe Biden lied when he said that John McCain was “dead wrong on Iraq”, because Joe Biden shared the same vote to authorize the war and they differed on the surge strategy where John McCain has been proven right.
12. TAX INCREASES: Biden said Americans earning less than $250,000 wouldn’t see higher taxes, but the Obama-Biden tax plan would raise taxes on individuals making $200,000 or more.
13. BAILOUT: Biden said the economic rescue legislation matches the four principles that Obama laid out, but in reality it doesn’t meet two of the four principles that Obama outlined on Sept. 19, which were that it include an emergency economic stimulus package, and that it be part of “part of a globally coordinated effort with our partners in the G-20.”
14. REAGAN TAX RATES: Biden is wrong in saying that under Obama, Americans won’t pay any more in taxes then they did under Reagan.

(AKI) – Al-Qaeda has over the past two years used 24 children to carry out suicide bombings in Iraq, the director of military operations for the Interior Ministry, Abdelaziz Mohammed Jasim, told pan-Arab daily al-Sharq al-Awsat."Of the 24 children, five had a mental disability. From analysing the others’ remains, we established that they were homeless," said Jasim.
American soldiers stationed in Iraq have reported that the insurgency has armed children as young as 11 to fight against them.
Al-Qaeda is targeting orphans, street children and mentally disabled children as suicide bomber recruits as well as women, according to the Iraqi Interior Ministry.
There have been at least 16 suicide attacks carried out by women in recent months in the volatile Al-Qaeda stronghold of Diyala province, north of the Iraqi capital, Baghdad.

As Somali pirates brazenly maintain their standoff with American warships off the coast of Africa, the cargo aboard one Iranian ship they commandeered is raising concerns that it may contain materials that can be used for chemical or biological weapons.
Some local officials suspect that instead of finding riches, the pirates encountered deadly chemical agents aboard the Iranian vessel.
On Aug. 21, the pirates, armed with AK-47s and rocket-propelled grenades, stole onto the decks of the merchant vessel Iran Deyanat.
They ransacked the ship and searched the containers. But in the days following the hijacking, a number of them fell ill and died, suffering skin burns and hair loss, according to reports.
The pirates were sickened because of their contact with the seized cargo, according to Hassan Osman, the Somali minister of Minerals and Oil, who met with the pirates to facilitate negotiations.
"That ship is unusual," Osman told the Long War Journal, an online news source that covers the War on Terror. "It is not carrying a normal shipment."
The pirates reportedly were in talks to sell the ship back to Iran, but the deal fell through when the pirates were poisoned by the cargo, according to Andrew Mwangura, director of the Kenya-based East African Seafarers’ Assistance Program.

Though Gadhafi asserted that fundraising from Arab and African nations were “legitimate,” the fact is that U.S. federal law bans any foreigner from donating to a U.S. election campaign.

A hugely important development that the US media are so far ignoring – because it would set back their passionate campaign to get Obama the Feeble elected? – is reported by the London Times:
Russia flexed its muscles in America’s backyard yesterday as it sent one of its largest warships to join military exercises in the Caribbean. The nuclear-powered flagship Peter the Great set off for Venezuela with the submarine destroyer Admiral Chabanenko and two support vessels in the first Russian naval mission in Latin America since the end of the Cold War.
“The St Andrew flag, the flag of the Russian Navy, is confidently returning to the world oceans,” Igor Dygalo, a spokesman for the Russian Navy, said. He declined to comment on Russian newspaper reports that nuclear submarines were also part of the expedition.
The voyage to join the Venezuelan Navy for manoeuvres came only days after Russian strategic nuclear bombers made their first visit to the country. Hugo Chávez, the President, said then that the arrival of the strike force was a warning to the US. The vehemently antiAmerican Venezuelan leader is due to visit Dmitri Medvedev, the Russian President, in Moscow this week as part of a tour that includes visits to Cuba and China.
Peter the Great is armed with 20 nuclear cruise missiles and up to 500 surface-to-air missiles, making it one of the most formidable warships in the world. The Kremlin has courted Venezuela and Cuba as tensions with the West soared over the proposed US missile shield in Eastern Europe and the Russian invasion of Georgia last month. Vladimir Putin, the Prime Minister, said recently that Russia should “restore its position in Cuba” – the nation where deployment of Soviet nuclear missiles in 1962 brought Russia and the United States to the brink of nuclear war.

“I don’t think there should be a prohibition against debate if it comes up in class. It doesn’t have to be part of the curriculum.”
She added that, if elected, she would not push the state Board of Education to add such creation-based alternatives to the state’s required curriculum.

As if in immediate reply to my last entry, Front Page Magazine today carries an article about one foresightful American who wants to take measures against the encroachment of sharia.
International reaction was almost uniformly negative last week when news broke that Britain had officially granted Muslim Sharia courts permission to rule on everything from divorce to domestic violence. After all, in its strictest form, Sharia law requires the stoning of women accused of adultery, and the execution of converts from Islam, among other draconian punishments for offences that aren’t even considered crimes in the West. In the U.K. and abroad, pundits and politicians denounced Britain’s capitulation, but only one elected official responded with a daring proposal aimed at preventing Sharia law from gaining such a foothold in America.
That that politician was Rep. Tom Tancredo won’t surprise observers of American politics. The Colorado congressman has long been an outspoken critic of the unofficial “open-borders” policy that encourages millions of undocumented immigrants – including would-be terrorists – to enter the U.S. each year. During his short-lived presidential campaign in 2007, Tancredo repeatedly raised the immigration issue during televised debates. He also aired a provocative television ad in which he promised to “stop all visas to nations that sponsor terrorism and [to] arrest and deport any alien who preaches violence and hatred.”
The ad earned Tancredo scorn on the Left and also on some parts of the Right. Undaunted, he has now proposed a “Jihad Prevention Act” that “would bar the entry of foreign nationals who advocate Sharia law [and] make the advocacy of Sharia law by radical Muslims already in the United States a deportable offense.” In his official announcement on September 18, Tancredo observed: “This is a case where truth is truly stranger than fiction. Today the British people are learning a hard lesson about the consequences of massive, unrestricted immigration.”
“When you have an immigration policy that allows for the importation of millions of radical Muslims,” he explained, “you are also importing their radical ideology – an ideology that is fundamentally hostile to the foundations of western democracy – such as gender equality, pluralism, and individual liberty. The best way to safeguard America against the importation of the destructive effects of this poisonous ideology is to prevent its purveyors from coming here in the first place.”
