Here, from the Wall Street Journal, is an article endorsing the idea quoted in the post below (Have they won?), that the states should curb the powers of the federal government; but setting out a more reasoned argument for how it might be done, by constitutional amendment.

For nearly a hundred years, federal power has expanded at the expense of the states—to a point where the even the wages and hours of state employees are subject to federal control. Basic health and safety regulations that were long exercised by states under their “police power” are now dominated by Washington.

The courts have similarly distorted the Constitution by inventing new constitutional rights and failing to limit governmental power as provided for in the document. The aggrandizement of judicial power has been a particularly vexing challenge, since it is inherently incapable of correction through the normal political channels.

There is a way to deter further constitutional mischief from Congress and the federal courts, and restore some semblance of the proper federal-state balance. That is to give to states—and through them the people—a greater role in the constitutional amendment process. 

The idea is simple, and is already being mooted in conservative legal circles. Today, only Congress can propose constitutional amendments—and Congress of course has little interest in proposing limits on its own power. Since the mid-19th century, no amendment has actually limited federal authority.

But what if a number of states, acting together, also could propose amendments? That has the potential to reinvigorate the states as a check on federal power. It could also return states to a more central policy-making role. …

The answer is to amend the Constitution to permit two-thirds of the states to propose amendments directly. To do so, of course, means that the states would have to first call for a constitutional convention—at which they could propose such a change.

What about the risk of a runaway convention? We think that risk is very small. In the first place, the Constitution is not the Articles of Confederation, which were ratified only six years before they were replaced.

By contrast, the American people are profoundly attached to the Constitution. It cannot and will not be replaced by an amending convention. In any event, nothing proposed at such a convention—including a change to the current amendment process—could be adopted without three-fourths of the state legislatures agreeing. …

The Framers of the U.S. Constitution never thought the balance of powers between states and the federal government would ever get so profoundly distorted. James Madison dismissed claims that the new federal government could displace the states as “chimerical fears,” assuring his readers in The Federalist Papers that “[t]he powers delegated by the proposed Constitution to the Federal Government, are few and defined. Those which are to remain in the State Governments are numerous and indefinite.” Indeed, the Framers considered a “vertical” separation of powers—between federal and state authority—just as important as guaranteeing the success of liberty as the “horizontal” separation of powers between the president, Congress and the courts.

True enough, re-establishing a proper balance—where, as Madison wrote in The Federalist Papers, Washington is responsible “principally [for] external objects” and the states for “all the objects, which, in the ordinary course of affairs, concern the lives, liberties and properties of the people”—will not be easy.

The gain will be substantial. Although it seems that permitting the states to propose amendments is a small thing, especially because ratification would still require three-fourths of the states to agree, it would shift the power calculus—and create a potential for action that the president, Congress and courts could never ignore as they consider the proper boundaries of their own authority.

Moreover, the effort to enable the states to check Washington’s power would provide a constructive outlet for much of the growing anger—specially evident in phenomena such as the “tea party” movement—toward the political elites of both parties. It is not a partisan proposal and is difficult to oppose. The purpose is to move significant authority closer to the electorate, but in a measured, “conservative” manner that is in no sense “populist.”

Opponents would have no fig leaf. They would have to openly argue that any effort to limit Washington’s reach is a bad thing. And that is an argument they are likely to lose.

With the federal government taking control of one sixth of the economy by means of ‘health care reform’, America is on the road to socialism and consequent decline, and it’s hard to see how the damage can be undone. Once entitlements are granted in law it becomes well nigh impossible to take them away again, as Europe has learnt the hard way.

Has America gone over the ‘precipice’, to use Obama’s word for this change? (We suspect he didn’t know what the word means, but it’s more apt than he could have intended.)

What sort of world is emerging with the connivance, or the capitulation, of the new weaker socialist America, which will no longer protect Western civilization?

Will America no longer be ‘the last best hope on earth’?

Is global government, the tyranny from which there can be no escape, inevitable?

Is there anything dissenting Americans – apparently a majority if the polls are right – can do to recover their liberty? Or is it too late to do anything?

Is there any point in looking to the Republican Party? Seems not, with its present leaders.

What if it had stronger leadership?

This morning on Fox Sunday with Chris Wallace, Sen. John McCain (R-Ariz.) conceded that Republican senators won’t be able to stop Democratic health care reform legislation from passing the Senate before Christmas.

In the good old days, when the three administrative branches of the federal government kept independent checks upon each other, politicians were able to hide behind their NAY vote as a demonstration of opposition to anti-American and unconstitutional policies.

Those days are gone!

The Republicans in Congress are very unlikely to take such bold action. So what remains? Many recognize that this is a critical moment for America and the world. Even among the well-behaved, mild-mannered Tea Party protestors there are some who talk of secession, and some even of revolution.

Many Americans are arming themselves. Is the revolution, if it comes, likely to be a violent one?

In a Townhall article which we quote from here, Roger Chapin sounds a warning about the weakening of America. He may be exaggerating when he speaks of a ‘nuclear doomsday’, but we do think that Obama is selling America down the river, wants world government and global redistribution of wealth, and that the transformation of America into a weak, decaying, impoverished, socialist country is a danger all too real.

Never before in our history has an American president, deliberately and by design, risked our very survival to a maniacal enemy power sworn to remove America from the world. Yet from all appearances, this is exactly what Obama is doing by failing to vigorously oppose Iran’s acquisition of nuclear weapons. But in spite of the fact that over 60% of the public favors militarily destroying Iran’s nuclear facilities, there’s nary a word of protest from the Republicans in opposition. They’re so paranoid about being labeled warmongers, they have shamefully abdicated their own national security responsibilities, just as John McCain did during his presidential run.

Obama is weakening rather than strengthening our missile defenses. That’s how seriously this Administration takes the Iranian threat.

The reality is that the fanatical, messianically driven radical Iranian zealots will pay any price, including Iran’s virtual obliteration, in order to render the U.S. and its major allies non-players on the world scene. The mullahs expect to emerge from the ruins no longer hindered by the “Great Satan,” free to use their huge oil and gas reserves to fund the imposition of their tyranny throughout the Middle East and beyond.

Not only does Obama’s psyche make him incapable of understanding the radical’s mentality but he chooses to totally dismiss their own pronouncements spelling out their sinister intentions. Obama’s determination to make the United States subservient to an international body of nations is now driving him to systematically reduce our nation to a mere shadow of its former power and influence. …

The practical consequences of Obama’s extreme radical left agenda can only be to put our nation at the mercy of a new world order dominated by ruthless tyrants, thugs and spineless states who sell their souls for commercial gain. His first allegiance is to such an international order – not to the United States.

Obama is not only unfit to serve as commander-in-chief in a time of war, he is a menace to our national security. His obvious intent to allow Iran to obtain nuclear weapons, perhaps under the guise of what would undoubtedly be a totally meaningless agreement not to do so, presents a risk so grave to our survival that it can only be rationally viewed as tantamount to national suicide. Under no circumstances can the mullahs be trusted to honor any agreement, as they’ve proven time and again. …

By almost any standard, Obama is flagrantly guilty of dereliction of duty. It cannot be overemphasized how extraordinarily perilous a situation we are in, especially at a time when virtually the entire Republican Party is AWOL on bombing Iran and strengthening national security. There is no counterweight to Obama’s disastrous policies. Obama himself recently acknowledged that if terrorists get nuclear weapons “we have every reason to believe they will use them.” Despite this admission, he refuses to take the only action that will stop them from acquiring such weapons.

If we citizenry will not take the bull by the horns and demand a total reversal of our nation’s suicidal course, we could very soon experience the apocalyptic end of the America we love and all western civilization. Let us understand that the maniacal, radical Islamic enemies confronting us are irreversibly committed to making such a cataclysmic event happen – no matter how horrific the cost to them. To think that an olive branch of brotherly love could change their goals is sheer madness.

Take heed America, Obama’s policies may be paving the way for a nuclear doomsday.

Are  Muslims to be allowed to erect a victor’s monument at Ground Zero? A permanent symbol of Islamic gloating and mockery? That is what a huge mosque next to the site of  9/11 would be.

An identified group with unknown sponsors has purchased building steps away from where the World Trade Center once stood — to turn it into potentially one of the largest New York City mosques.

At the moment the building, the old Burlington Coat Factory, already serves as a mini-mosque: an iron grill lifts every Friday afternoon for a little known Imam leading prayers a few yards away from where Osama Bin Laden’s airborne Islamist bombers killed nearly 3000 people back in 2001.

The Imam, Feisal Abdul Rauf, told the New York Times — which put the story on its front page Wednesday — that he has assembled several million dollars to turn it into ‘’an Islamic center near the city’s most hallowed piece of land that would stand as one of ground zero’s more unexpected and striking neighbors.’’

What is going on in the US Defense Department? There are people in it who seem to be positively on the side of the enemy.

The internal threat from Muslim extremists in the military extends to high-level Defense Department aides who have undermined military policy. In fact, one top Muslim adviser pushed out an intelligence analyst who warned of the sudden jihad syndrome that led to the Fort Hood terrorist attack.

An honored guest of the Ramadan dinner at the Pentagon this September was Hesham Islam, who infiltrated the highest echelons of the Ring despite proven ties to U.S. terror front groups and a shady past in his native Egypt.

As senior adviser for international affairs to former deputy Defense Secretary Gordon England, Islam … persuaded brass to sack a Pentagon analyst, Stephen Coughlin, after he advised cutting off outreach to ISNA, which he accurately ID’d as part of a covert terror-support network in the U.S. — something the Justice Department recently confirmed in a major terror finance trial.

Islam invited ISNA [Islamic Society of North America] officials to lunch with the avuncular England, known by insiders as Gullible Gordon, who in turn spoke at ISNA confabs. Islam also helped set up a Pentagon job booth at one recent ISNA convention to recruit Muslim chaplains and linguists.

Most disturbing, Islam met regularly with Saudi and other embassy officials lobbying for the release and repatriation of their citizens held at Gitmo. He in turn advised England, who authorized the release of dozens of Gitmo detainees. Some have resumed terrorist activities.

No one really knew who Islam was when he was promoted — in fact, the Pentagon removed his bio from its Web site after reporters noted major inconsistencies in it — yet he was allowed to get inside the office of the Pentagon’s No. 2 official.

“In effect,” a senior U.S. Army intelligence official told me, “we’ve got terrorist supporters calling the shots on our policies toward Muslims from the highest levels.”

Meanwhile, politically incorrect prophets like Coughlin have been frozen out. …

Coughlin … warned that by using ISNA and other radical [Muslim] Brotherhood fronts to endorse Muslim chaplains and recruit Muslim soldiers, they were courting enemies of the U.S. — and courting disaster. But they were too drunk with political correctness to listen. …

The Fort Dix terrorists …  talked about joining the U.S. Army so they could kill U.S soldiers from the “inside.” …  Some of them [like Nidal Malik Hasan, the Muslim terrorist of Fort Hood -JB] were inspired by al-Qaida preacher Anwar Awlaki, who on his Yemen-based Web site calls for jihad against U.S. military targets inside and outside the U.S.

But so do so-called moderate American clerics like Zaid Shakir. … Frequently booked by the Council on American-Islamic Relations (CAIR) as a guest speaker at its events, Shakir tells his Muslim audience: “Jihad is physically fighting the enemies of Islam to protect and advance the religion of Islam. This is jihad.”

Acceptable targets of jihad, he says, include U.S. military aircraft. “Islam doesn’t permit us to hijack airplanes filled with civilian people,” he said, but “if you hijack an airplane filled with the 82nd Airborne, that’s something else.”

The 82nd Airborne is based out of Fort Bragg, which is part of North Carolina state Sen. Larry Shaw’s home district. Shaw is CAIR’s new chairman. He is also a minority contractor who operates Shaw Food Services Co. near Fort Bragg. According to the legislator’s financial disclosure form, Shaw Food customers include the Defense Department. …

CAIR, like ISNA, is an unindicted terrorist co-conspirator. The FBI says CAIR is a terrorist front group and has cut off formal ties to it. So should the military. …

This enemy is hiding behind a religion, making it easier for them to infiltrate our sensitive security agencies. Communist spooks did not have such an advantage. …

Military command must stop currying favor with suspect Muslim groups and start beefing up counterintelligence activities. It must institute a policy of zero tolerance for Jihad Joes in the ranks.

And while we’re trying to digest that, here’s another piece of information we must swallow to make the heartburn worse – an Obama program making it easy for foreign Muslims to join the US armed forces:

Illegal aliens with “special skills,” such as speaking Arabic, Dari, Pushti and other languages are now allowed to enlist in the U.S military. There is NO requirement that these people be in the United States legally. No background check! A Muslim Pushti speaker could sneak across the Rio Grande today and be getting 3 hots and a cot (meals and a place to sleep) in the U.S. Military tomorrow! Even worse, he would be on a path to get citizenship in less time than any other naturalized citizen in history! Special “citizenship expediters” at military bases across the country rush their citizenship papers through in as little as 10 weeks.

Does Obama mean to pack the army with potential traitors?

Roger Scruton sets out the opposing ethical-political views of conservatives and liberals in his article Totalitarian Sentimentality in The American Spectator. It is well worth reading in full.

In part he writes:

The USA has descended from its special position as the principled guardian of Western civilization and joined the club of sentimentalists who have until now depended on American power. In the administration of President Obama we see the very same totalitarian sentimentality that has been at work in Europe, and which has replaced civil society with the state, the family with the adoption agency, work with welfare, and patriotic duty with universal “rights”. The lesson of postwar Europe is that it is easy to flaunt compassion, but harder to bear the cost of it. Far preferable to the hard life in which disciplined teaching, costly charity, and responsible attachment are the ruling principles is the life of sentimental display, in which others are encouraged to admire you for virtues you do not possess. This life of phony compassion is a life of transferred costs. Liberals who wax lyrical on the sufferings of the poor do not, on the whole, give their time and money to helping those less fortunate than themselves. On the contrary, they campaign for the state to assume the burden. The inevitable result of their sentimental approach to suffering is the expansion of the state and the increase in its power both to tax us and to control our lives.

As the state takes charge of our needs, and relieves people of the burdens that should rightly be theirs — the burdens that come from charity and neighborliness — serious feeling retreats. In place of it comes an aggressive sentimentality that seeks to dominate the public square. I call this sentimentality “totalitarian” since — like totalitarian government — it seeks out opposition and carefully extinguishes it, in all the places where opposition might form. Its goal is to “solve” our social problems, by imposing burdens on responsible citizens, and lifting burdens from the “victims,” who have a “right” to state support. The result is to replace old social problems, which might have been relieved by private charity, with the new and intransigent problems fostered by the state: for example, mass illegitimacy, the decline of the indigenous birthrate, and the emergence of the gang culture among the fatherless youth. We have seen this everywhere in Europe, whose situation is made worse by the pressure of mass immigration, subsidized by the state. The citizens whose taxes pay for the flood of incoming “victims” cannot protest, since the sentimentalists have succeeded in passing “hate speech” laws and in inventing crimes like “Islamophobia” which place their actions beyond discussion. This is just one example of a legislative tendency that can be observed in every area of social life: family, school, sexual relations, social initiatives, even the military — all are being deprived of their authority and brought under the control of the “soft power” that rules from above.

This is how we should understand the award of the Nobel Peace Prize to President Obama. … The prize is an endorsement from the European elite, a sigh of collective relief that America has at last taken the decisive step toward the modern consensus, by exchanging real for fake emotion, hard power for soft power, and truth for lies. What matters in Europe is the great fiction that things will stay in place forever, that peace will be permanent and society stable, just so long as everybody is “nice.” Under President Bush … America maintained its old image, of national self-confidence and belligerent assertion of the right to be successful. Bush was the voice of a property-owning democracy, in which hard work and family values still achieved a public endorsement. As a result he was hated by the European elites, and hated all the more because Europe needs America and knows that, without America, it will die. Obama is welcomed as a savior: the American president for whom the Europeans have been hoping — the one who will rescue them from the truth.

Obama has sent a letter to Kim Jong Il, the contents of which are not disclosed to the American people who pay the president to conduct their foreign relations. What on earth has he written? Does he imagine that something he says can suddenly transform the murderous little squirt who tyrannizes over North Korea into a nice reasonable guy who only wants the best for everyone?

Or does the letter ask for advice on how to attain absolute power?

The fact is, Kim, while cunning in his pursuit of self-preservation, is a sociopath, a mass murderer of his own people, responsible for the death by famine and torture of as many as 3 million North Koreans. The idea that you can make a rational appeal to his moral conscience is, well, beyond silly. …

By some estimates Kim has killed 3.5 million people or more out of a population of 23 million. The murder toll includes children and infants. The deaths have come from starvation, beatings, torture and inhumane incarceration in hellish concentration camps.

It’s bad enough that we tolerate genocide. But someday soon, he — or his ally, Iran — will have the means to attack us. Just last week, a North Korean plane was detained in Bangkok carrying 35 tons of missiles, explosives and other weaponry. Where it was going, no one’s sure. No doubt we’ll send them a stern letter in rebuke.
